Chapter One: General Provisions

1. Introduction

This Acceptable Use Policy (the "Policy") sets out the rules and controls governing the use of all Wthaiq services.

This Policy aims to protect the Platform, its Users, and its service providers, and to ensure that the services are used in a lawful, secure, and responsible manner.

This Policy forms an integral part of the Terms and Conditions of Use, the User Agreement, the Privacy Policy, and all the other legal policies of Wthaiq.


2. Scope of Application

This Policy applies to all Users of the Platform, including:

  1. Account holders.
  2. Authorised Users.
  3. Users of the free edition.
  4. Subscribers to the paid plans.
  5. Users of the application programming interfaces (API).
  6. Any person who uses the Wthaiq services directly or indirectly.

3. Compliance with the Laws

All Users undertake to use the Wthaiq services in conformity with:

  1. The laws.
  2. The regulations.
  3. The statutes.
  4. Judicial orders.
  5. Regulatory decisions.

Applicable in the relevant State or jurisdiction.


4. Responsible Use

The Platform must be used in a manner that is:

  1. Lawful.
  2. Responsible.
  3. Secure.
  4. Not harmful to the Platform.
  5. Not harmful to the other Users.
  6. Not harmful to third parties.

Chapter Two: Prohibited Uses

5. Unlawful Activities

The use of the Platform in any activity that contravenes the law is prohibited, including by way of example and not limitation:

  1. Fraud.
  2. Money laundering.
  3. Terrorist financing.
  4. Forgery.
  5. Impersonation.
  6. Electronic fraud.
  7. Financial crimes.
  8. Information technology crimes.
  9. Any activity prohibited by law.

6. Misuse of Documents

It is prohibited to create, upload, share, or sign documents that are:

  1. Forged.
  2. Fraudulent.
  3. Misleading.
  4. In breach of the law.
  5. In violation of the rights of third parties.
  6. Deliberately containing incorrect data.

7. Impersonation

The User is prohibited from:

  1. Impersonating any individual.
  2. Impersonating any company or governmental entity.
  3. Using the data of another person without authorisation.
  4. Using an email address that the User is not entitled to use.
  5. Providing false identity information.

8. Misuse of Accounts

The User is prohibited from:

  1. Creating fictitious accounts.
  2. Creating multiple accounts for the purpose of circumvention.
  3. Selling accounts.
  4. Renting out accounts.
  5. Sharing accounts in breach of the subscription terms.
  6. Using an account belonging to a third party without authorisation.

9. Misuse of the Electronic Signature Services

The User is prohibited from:

  1. Sending signature requests without the knowledge of the persons to whom they pertain.
  2. Compelling any person to sign.
  3. Using verification means belonging to third parties.
  4. Amending the document after it has been signed without disclosing this.
  5. Using the service to support unlawful transactions.

10. Misuse of Artificial Intelligence

The use of the artificial intelligence services is prohibited for:

  1. Producing unlawful content.
  2. Creating fraudulent documents.
  3. Impersonating persons or entities.
  4. Misleading Users.
  5. Infringing intellectual property rights.
  6. Processing data that the User is not entitled to use.
  7. Circumventing the security or operational restrictions of the service.

Chapter Three: Platform Security

11. Misuse of the Technical Infrastructure

The User is prohibited from undertaking any activity that is intended to lead, or that may lead, to:

  1. Disrupting the Platform.
  2. Affecting the stability of the services.
  3. Consuming resources in an abnormal manner.
  4. Affecting the experience of the other Users.
  5. Disrupting the servers or the databases.
  6. Impeding the operation of the networks or the infrastructure.

12. Malicious Software

It is prohibited to upload, transmit, run, or disseminate any:

  1. Virus.
  2. Trojan horse.
  3. Ransomware.
  4. Spyware.
  5. Malicious code.
  6. Harmful files.
  7. Software intended to breach or disrupt systems.

13. Reverse Engineering

Unless the law expressly permits this, the User is prohibited from:

  1. Carrying out reverse engineering.
  2. Decompiling the code.
  3. Extracting the source code.
  4. Analysing the internal structure of the Platform.
  5. Circumventing the technical protection measures.
  6. Attempting to discover or exploit security vulnerabilities.

14. Unauthorised Security Testing

The User may not carry out:

  1. Penetration tests.
  2. Load tests.
  3. Scanning for security vulnerabilities.
  4. Monitoring of network traffic.
  5. Any technical test that may affect the stability of the services.

Save after obtaining the prior written consent of Wthaiq.


15. Unauthorised Access

The User is prohibited from:

  1. Attempting to access the accounts of others.
  2. Accessing data that the User is not entitled to access.
  3. Exceeding the permissions of the account.
  4. Using tools to crack passwords.
  5. Circumventing the authentication systems.
  6. Attempting to access the internal systems of the Platform.

Chapter Four: Misuse of the Services

16. Circumvention of the Usage Limits

The User is prohibited from circumventing:

  1. The subscription limits.
  2. The storage limits.
  3. The limits on the number of documents.
  4. The limits on the number of Users.
  5. The limits of the application programming interfaces.
  6. The artificial intelligence limits.
  7. Any other operational or contractual restrictions.

17. Misuse of the Application Programming Interfaces (API)

Where the Platform provides programming interfaces, the User is prohibited from:

  1. Exceeding the request limits.
  2. Sharing access keys.
  3. Reselling access to the interface.
  4. Using them to create a competing service.
  5. Using them in unlawful activities.
  6. Attempting to disrupt them or to affect their performance.

18. Automated Data Extraction (Scraping)

It is prohibited to use any automated or manual means for the purpose of:

  1. Extracting the data.
  2. Copying the databases.
  3. Archiving the content of the Platform.
  4. Monitoring the services in a manner that affects their performance.
  5. Creating databases derived from the content of Wthaiq.

Unless the Platform has agreed to this in writing.


19. Unsolicited Mail (Spam)

It is prohibited to use the Platform to send:

  1. Unsolicited bulk messages.
  2. Fraudulent messages.
  3. Marketing messages that contravene the law.
  4. Deceptive links.
  5. Harmful or nuisance messages.

20. Misuse of Resources

It is prohibited to use the Platform in a manner that results in abnormal or unreasonable consumption of its technical resources, including:

  1. Generating excessive automated requests.
  2. Running scripts that affect performance.
  3. Using the Platform in a manner that results in the disruption of the services.
  4. Exploiting software errors in order to obtain undue advantages.

The Platform may impose temporary or permanent restrictions on accounts that cause excessive consumption affecting the stability of the services.

Chapter Five: Intellectual Property and Content

21. Respect for Intellectual Property Rights

The User undertakes to respect all intellectual property rights belonging to Wthaiq or belonging to third parties.

The Platform may not be used in a manner that infringes copyright, trade marks, patents, trade secrets, or any other intellectual property rights.


22. Infringing Content

It is prohibited to upload, create, share, or store any content that:

  1. Infringes intellectual property rights.
  2. Contains trade secrets without authorisation.
  3. Contains personal data belonging to third parties without a legal basis.
  4. Contravenes the laws or the statutes.
  5. Contains deliberately fraudulent or misleading information.
  6. Is intended to cause harm to any person or entity.

23. Reporting Infringements

Any person who believes that content published through the Platform infringes that person's legal rights or that person's intellectual property rights may contact Wthaiq through the official channels.

The Platform may request documents or information in order to verify the request before taking any action.


Chapter Six: Platform Measures

24. Monitoring of Misuse

Wthaiq may, to the extent necessary to protect its services and its Users, monitor the technical indicators and the operational activities in order to detect misuse or activities that breach this Policy.

This monitoring is not intended to review the content belonging to Users, save within the limits permitted by law or required by operational or security requirements.


25. Corrective Measures

If it appears to the Platform that there is a breach of this Policy, it may take any appropriate measure, including:

  1. Issuing a warning.
  2. Restricting certain features.
  3. Temporarily suspending the account.
  4. Terminating the account.
  5. Deleting the infringing content.
  6. Refusing to process certain requests.
  7. Suspending the subscription.
  8. Taking the appropriate legal measures.

The measure is selected in proportion to the nature of the breach, its gravity, and its recurrence.


26. Cooperation with the Competent Authorities

The Platform may cooperate with the competent judicial, security, or regulatory authorities where this is required under the law or in response to binding statutory orders or requests.


Chapter Seven: Reporting Security Vulnerabilities

27. Responsible Disclosure

Wthaiq welcomes the responsible reporting of security vulnerabilities.

The person making the report undertakes the following:

  1. Not to exploit the vulnerability in order to obtain personal benefit.
  2. Not to access User data without authorisation.
  3. Not to disrupt the services.
  4. To grant the Platform a reasonable opportunity to remedy the vulnerability before disclosing it publicly.

This clause does not grant any authorisation to carry out security testing without prior consent.


Chapter Eight: General Provisions

28. Amendment of the Policy

Wthaiq may amend this Policy at any time where operational, security, or legal necessity so requires.

The amendments enter into force from the date of their publication or from the date specified therein.


29. Conflict of the Policy with the Law

If any provision of this Policy conflicts with a mandatory applicable law, that law shall apply to the extent necessary to resolve the conflict, with the remaining provisions continuing in force.


30. Entry into Force

This Acceptable Use Policy enters into force as of the date specified at its beginning, and remains applicable throughout the period of use of the Wthaiq services, and the continued use of the Platform is deemed to constitute agreement to be bound by all of its provisions.

Chapter Nine: Advanced Provisions on Acceptable Use

31. Misuse of Artificial Intelligence

The User is prohibited from using any of the artificial intelligence services available through the Platform for the purpose of:

  • Creating or disseminating information that the User knows, or is presumed to know, to be misleading or fraudulent.
  • Producing documents that are forged or altered with intent to deceive.
  • Impersonating persons or entities.
  • Circumventing the technical or operational restrictions imposed on the service.
  • Attempting to extract or reconstruct the artificial intelligence models or their training data.
  • Using the service in any activity that contravenes the laws, the statutes, or this Policy.

32. Misuse of the Cloud Infrastructure

It is prohibited to use the resources of the Platform for:

  • Digital mining.
  • Running applications or services unrelated to the purpose designated for the Platform.
  • Hosting files or content that does not serve the use of the services.
  • Consuming resources in a manner that affects the remaining Users.

33. Misuse of Storage

The storage space provided by Wthaiq may not be used as a general means of retaining files, of backup, or of sharing content unrelated to the use of the Platform's services.

The Platform may remove files that contravene the purpose designated for the service or that consume resources in an unreasonable manner, after taking such measures as it deems appropriate.

34. Circumvention of the Security Measures

The User is prohibited from attempting to disable, bypass, or circumvent any security or technical measure used by Wthaiq, including:

  • The fraud detection systems.
  • The authentication systems.
  • The identity verification systems.
  • The usage rate limiting systems.
  • The other technical protection measures.

35. Unlawful Competition

It is prohibited to use the Platform, its services, its content, its interfaces, or its outputs for the purpose of developing, training, improving, or operating a competing service that relies substantially on the services or the content of Wthaiq, unless the Platform has agreed to this in writing.


Chapter Ten: Enforcement and Penalties

36. Assessment of the Breach

Wthaiq reserves the right to assess the nature of the breach, its effects, and the extent of its seriousness, and to take the measure that it deems appropriate in a manner proportionate to the circumstances of each case.

37. Measures Not Exhaustive

The right of the Platform is not confined to the measures provided for in this Policy, and it may use any means or measure permitted by law or by the agreements concluded with the User in order to protect its services, its Users, or its rights.

38. No Exemption from Liability

The deletion of the infringing content, or the suspension or termination of the account, does not exempt the User from any legal or contractual liability that has arisen as a result of the User's breach.

39. Indemnification

If the User's breach of this Policy results in any losses, claims, damages, or costs borne by Wthaiq as a result of that breach, the User undertakes to indemnify the Platform in accordance with the indemnification provisions set out in the Terms and Conditions of Use, this being to the extent permitted by law.

40. Final Acknowledgement

The User acknowledges that the User has read the Acceptable Use Policy, has understood all the restrictions and obligations set out therein, and agrees to be bound by it when using any of the Wthaiq services, and any use of the services after the date of entry into force of this Policy is deemed to constitute binding acceptance of all of its provisions.

Chapter Eleven: Additional Provisions

41. Commercial Use of the Services

The Wthaiq services may not be used to provide similar or competing services to third parties, nor may they be resold, rented out, or sub-licensed, save after obtaining the prior written consent of the Platform.

42. Automated Use

It is prohibited to use Bots, Scripts, or any automated means to interact with the services of the Platform, unless those means are officially authorised through the application programming interfaces (API) or by written consent from Wthaiq.

43. Misuse of the Free Edition

Where the Platform provides a free plan, the User may not:

  • Create multiple accounts in order to circumvent the usage limits.
  • Use technical means in order to obtain undue advantages.
  • Re-register repeatedly in order to avoid the restrictions or the fees.
  • Exploit software errors in order to obtain additional services.
  • The Platform may merge, suspend, or terminate the accounts upon discovering any of those practices.

44. Integrity of the Content

The User alone bears responsibility for ensuring that all files, documents, or data that the User uploads to the Platform:

  • Are free from malicious software.
  • Do not infringe the rights of third parties.
  • Do not contravene the laws.
  • Do not expose the Platform or its Users to any security risks.

45. Incident Response

If Wthaiq detects activity that may threaten the security of the Platform or of the Users, it may take immediate measures, including:

  • Suspending the active sessions.
  • Restricting certain functions.
  • Temporarily disabling the account.
  • Resetting the login credentials.
  • Requesting verification of the User's identity.
  • Taking any technical or legal measure that it deems necessary to protect the services.

46. Cooperation with Investigations

The User undertakes, upon the reasonable request of Wthaiq, to cooperate in the investigation of any misuse or security incident relating to the User's account, this being to the extent permitted by law and without prejudice to the User's statutory rights.

47. No Circumvention of the Fees

It is prohibited to use any means or arrangement intended to avoid the fees or the subscriptions due, or to obtain undue discounts or advantages.

The Platform may correct any accounting or technical error and recover the amounts due, wherever this is legally permissible.

48. Priority of Platform Security

In the event of a conflict between the interest of an individual User and the requirements of protecting the security of the Platform, of the remaining Users, or of compliance with the law, the Platform may take such measures as it deems appropriate to protect the security of its services, including restricting certain functions or suspending the account.

49. Integration with the Other Policies

This Policy shall be construed together with the Terms and Conditions of Use, the User Agreement, the Privacy Policy, the Cookies Policy, and any other policies issued by Wthaiq, as an integrated legal framework.

50. Final Acknowledgement

The User acknowledges that any breach of this Policy may lead to contractual, technical, or legal measures being taken against the User, and that the User undertakes to use the Wthaiq services in a lawful, responsible, and secure manner, in accordance with all the legal documents approved by the Platform.


Governing Law and Jurisdiction

This document shall be governed by and construed in accordance with the laws of the Arab Republic of Egypt, and the competent Egyptian courts shall have jurisdiction to determine any dispute arising out of it or relating to it, and any arbitration — should the two parties agree upon it — shall be conducted within the Arab Republic of Egypt and in accordance with its laws, without prejudice to any mandatory rights afforded to the User under the applicable laws of the User's country of residence.
